A Hiccup Along the Way

July 22, 2005

Greentree Realty, LLC, the property owner of the Metro Enviro waste transfer facilty, used the following court documents in the Supreme Court of the State of New York in White Plains, ajoining Metro Enviro on July 21, 2005, to secure temporary restraining order that will stall Metro Enviro's closure, which was set for July 23, 2005.

The gist... According to the Pleadings document, Greentree Realty LLC asks the courts to keep "Respondents (The Village of Croton-on-Hudson) from prohibiting or in any way interfering with Petitioner Greentree Realty’s (“Greentree”) use, including its ability to lease and/or operate, the Property for the purposes of solid waste management, including, in particular, the Property’s current use as host to the existing Facility;"

Today, Village Manager Richar Herbek, Village Attorney Marianne Stecich and Attorney Michael Girrard will be in Westchester County Supreme Court to argue against the temporary stay recently granted by state Supreme Court judge Justice Francis A. Nicolai.

Oh and here are a few links to just the last two days worth of articles on the organized crime waste scandals involving the feds, Westchester, Putnam, Connecticut, Allied, Kisco, Mamaroneck, AWD and other firms. If they don’t work, just paste them into your browser. The links may only last a few more days and are linked here, here, here & here.

Thank you for providing the PDF documents as well. For those who for one reason or another cannot open PDF files, however, all the documents have also been scanned into OCR, plain text word files and are available by emailing CCC1@bestweb.net

There will be some formatting changes but the text is otherwise the same.

Thanks so much Çrotonblog. Posting the actual court documents being considered in the on-going ME battle is extremely helpful. It allows us o sift through all the verbiage and narrative and make our own decisions about what’s happening.

My opinion? This may well be “A Hickup Along the Way” but it’s only the very beginning of many more gut wrenching battles ahead. The fact that the “owner” of the property, Greentree is now putting its face forward is very telling.

Please continue to give us the official documents on crotonblog as they become available. You provide a very valuable service to the village.
