Greentree Realty, LLC, the property owner of the Metro Enviro waste transfer facilty, used the following court documents in the Supreme Court of the State of New York in White Plains, ajoining Metro Enviro on July 21, 2005, to secure temporary restraining order that will stall Metro Enviro's closure, which was set for July 23, 2005.

The gist... According to the Pleadings document, Greentree Realty LLC asks the courts to keep "Respondents (The Village of Croton-on-Hudson) from prohibiting or in any way interfering with Petitioner Greentree Realty’s (“Greentree”) use, including its ability to lease and/or operate, the Property for the purposes of solid waste management, including, in particular, the Property’s current use as host to the existing Facility;"

Today, Village Manager Richar Herbek, Village Attorney Marianne Stecich and Attorney Michael Girrard will be in Westchester County Supreme Court to argue against the temporary stay recently granted by state Supreme Court judge Justice Francis A. Nicolai.

Thanks so much Çrotonblog. Posting the actual court documents being considered in the on-going ME battle is extremely helpful. It allows us o sift through all the verbiage and narrative and make our own decisions about what’s happening.

My opinion? This may well be “A Hickup Along the Way” but it’s only the very beginning of many more gut wrenching battles ahead. The fact that the “owner” of the property, Greentree is now putting its face forward is very telling.
